Based on extensive study and analysis, we have developed a set of Recommendations for a Vermont Policy on Conservation Easement Amendment and Termination. We present these Recommendations in the hope they will help expand public awareness of the perpetuity issue and encourage the development of new laws and policies that provide more robust protection for easements. The Recommendations start with a set of principles that we believe should shape policies governing the amendment and termination of easements in Vermont. These are followed by proposed rules, standards and procedures that should govern easement amendment and termination. Finally, the Recommendations discuss certain topics that we think should be addressed in any comprehensive effort to reform Vermont’s system of conservation easement protection.
